Do I Need an EPR Authorised Representative in the EU?

Selling into the EU does not automatically produce the same answer in every country or for every product. Use this practical guide to identify the producer, separate packaging, WEEE and battery rules, and decide where an EPR authorised representative may be required.

The 30-second Answer

You are likely to need an EPR authorised representative when your business is the legally defined producer and makes a regulated product or packaging available in an EU Member State where it is not established. This applies EU-wide under PPWR Article 45 from 12 August 2026—and it catches EU-established businesses selling cross-border, not only non-EU sellers. This is especially relevant to direct-to-consumer cross-border sellers.

But there is no reliable “one answer for the whole EU”. Packaging, waste electrical and electronic equipment (WEEE) and batteries have different legal bases. The identity of the producer can also change when an EU importer, distributor or marketplace arrangement sits between you and the end user.

The correct unit of analysis is: legal entity × destination country × sales route × waste stream.

What Is an EPR Authorised Representative?

Extended producer responsibility makes the producer financially, and often operationally, responsible for products or packaging when they become waste. An EPR authorised representative is a person or legal entity established in the relevant Member State and appointed by written mandate to fulfil specified EPR obligations for a producer that is not established there.

Depending on the law and national system, the representative may coordinate registration, reporting, producer responsibility organisation membership, fee payment, regulator communications and record maintenance. The producer should still confirm exactly which obligations are transferred by law and by the written mandate.

IMPORTANT DISTINCTION
“Authorised representative” is not one universal EU role. An EPR representative deals with waste-related producer responsibility. A product-safety or CE authorised representative, an EU Responsible Person and a VAT fiscal representative perform different legal functions.

Five questions that decide most cases

  1. Which legal entity makes the sale? Review the entity named on the offer, invoice and customer terms.
  2. Who is the “producer” under the relevant law? It may be a manufacturer, importer, distributor or distance seller.
  3. Is the customer an end user or a reseller? Direct-to-user sales commonly shift producer responsibility to the foreign seller.
  4. Which products and packaging cross the border? One SKU can trigger several EPR regimes.
  5. In which Member State does first supply occur? Registration and appointment are normally organised country by country.

The Answer Changes for Packaging, WEEE and Batteries

“EPR” describes a policy model, not a single registration. Each waste stream has its own producer definition and appointment rule.

Cross-border seller focus

Regulation (EU) 2025/40 generally applies from 12 August 2026. Its producer definition includes EU and third-country businesses that first make packaging or packaged products available directly to end users in another Member State.

Practical answer: an EU-established producer selling directly to end users in another Member State must appoint an EPR authorised representative there by written mandate. For a producer established in a third country, Article 45(3) allows each destination Member State to make appointment mandatory.

Non-EU sellers should therefore confirm the destination country's appointment rule, register and transition process before launching sales; PPWR does not create one automatic answer for every third-country seller across all 27 Member States.

BATTERIES · REGULATION 2023/1542

The clearest appointment test

Regulation (EU) 2023/1542 defines a producer to include a business established in another Member State or a third country that sells batteries—including batteries incorporated in products—by distance contract directly to end users.

Practical answer: Article 56(3) requires that distance-selling producer to appoint an EPR authorised representative by written mandate in each Member State in which it sells batteries.

Check national transposition

Article 17 of Directive 2012/19/EU establishes the authorised-representative framework for producers selling electrical and electronic equipment into Member States where they are not established.

Practical answer: EU-established distance sellers must appoint an authorised representative in the destination Member State. The Commission's WEEE FAQ states that third-country distance sellers are producers and must register in every destination country; where they are not registered directly, registration must be completed through an authorised representative.

Because the Directive is implemented through national law, the registration route, mandate evidence and representative liability can vary. Verify each destination country.

Do not stop after checking the main product
A rechargeable headset may be EEE, contain a battery and arrive in several layers of packaging. Accessories, printed manuals, cables, promotional inserts and shipping materials can also affect category and data mapping.

Four Common Seller Scenarios

The commercial route often matters more than where the product was manufactured.

US, UK or Asian brand ships directly to EU consumers
The foreign seller will often be the producer for the destination market. If the product is packaged, electrical or battery-powered, run a separate EPR and representation check for each stream before launch.

Non-EU supplier sells wholesale to an EU importer
The EU importer may become the producer when it first places the goods on its domestic market. This can reduce the foreign supplier's EPR exposure, but responsibility should be documented rather than inferred from delivery terms alone.

Seller uses marketplace fulfilment across several countries
Importation, storage and cross-border fulfilment can produce several country touchpoints. A marketplace may request registration numbers, but its verification process does not automatically take over the seller's legal obligations.

Being established in Germany does not make the company established in France or Italy. Cross-border producer and appointment rules must be checked in both destination markets for each relevant waste stream.

GPSR EU Responsible Person vs EPR Authorised Representative

These titles sound similar because both can involve an EU-based contact and a written mandate. Legally, however, they belong to different compliance systems: GPSR concerns product safety, while EPR concerns responsibility for products or packaging when they become waste.

The distinction sellers most often miss
Under the GPSR, the “responsible person” is a functional product-safety role. Depending on the supply chain, it may be the EU manufacturer, importer, a manufacturer-appointed authorised representative or, where no other qualifying operator exists, a fulfilment service provider. An authorised representative is therefore one possible route to meeting the responsible-person requirement—not a universal name for every responsible person.

How Many EPR Representatives Might You Need?

There is no single “EU EPR AR” appointment that automatically covers every Member State and every waste stream. The representative generally needs to be established in the country concerned, and the written mandate must match the applicable law.

That does not always mean using a different service provider for every appointment. A provider may coordinate a network across countries, but the underlying registrations and legal mandates remain country- and category-specific.

A practical way to control scope
Start with countries where sales are live or planned in the next 90 days. Map only the SKUs entering each market, identify the relevant waste streams and then confirm producer status. This prevents paying for registrations that are not yet needed while avoiding launch-blocking gaps.

Frequently Asked Questions

Is a GPSR EU Responsible Person the same as an EPR authorised representative?

No. The GPSR role supports product-safety documentation, traceability and authority cooperation. An EPR authorised representative supports specified waste-related obligations in the relevant country and category. One provider may perform both roles only if it is eligible and each role is separately documented.

Does every non-EU seller need an EPR authorised representative?

No. First determine whether the seller is the producer under the applicable packaging, WEEE or battery rule. A non-EU seller shipping directly to end users is frequently the producer; a seller supplying an independent EU importer may reach a different result.

Do I need one representative for the whole EU?

Usually not. Appointment and registration are organised at Member State level. A service provider may coordinate several countries, but local mandates and country registrations remain separate.

If I have an EU VAT number, am I established for EPR?

Not automatically. VAT registration, OSS or IOSS participation, an EU bank account, a marketplace account or stock held by a fulfilment provider does not by itself prove that the selling entity is legally established in a Member State for EPR purposes.

Do B2B sales avoid the EPR representative requirement?

Not automatically. A business customer can still be an end user rather than a reseller. Determine whether the customer uses the product or resells it, then apply the producer definition for packaging, WEEE and batteries separately.

Does a marketplace become my EPR representative?

No, not merely because it hosts listings, stores stock or checks EPR numbers. Representation normally requires a valid written mandate and a party that meets the legal conditions in the destination country.

Can the same company be my packaging, WEEE and battery representative?

Potentially, if it is eligible and authorised for every relevant stream in that country. Each mandate, registration and service scope should expressly cover the applicable obligations; one appointment should never be assumed to cover all categories.

Does appointing an EPR representative complete my compliance?

No. You may still need producer registration, PRO membership, periodic reporting, environmental fee payment, product or packaging data, marketplace evidence and ongoing renewals. Confirm who performs each task in writing.
